Also, beneficial to read Mufti Shafi/Rafi and Shaykh Qaradawi's works on the subject. Also, found an interesting passage in Shaykh Mustafa Sabri's Mawqif al-Aql where he says; in comparison to Roman and French law, that the 'asas' of the Shari'ah is 'hurriyat al-fard' or individual freedom (as default) (vol.4, pg.268). Hence, Zakah, Nafaqah and other obligations are exceptions to the rule.
