نعم يجوز، فلا أحد فوق القانون، لكن بشروط وضوابط تحددها صفة الحضور:
* بصفته الوظيفية (قضايا مدنية/إدارية): لا يحضر الوزير بشخصه، بل تنوب عنه وتمثله حصرياً "هيئة قضايا الدولة".
* كشاهد (قضايا جنائية): يجوز لمحكمة الجنايات استدعاؤه، لكن الأمر يخضع لـ"السلطة التقديرية للقاضي" الذي يرفض الطلب إذا وجده كيدياً أو غير منتج في الدعوى.

الورقة الرسمية وغير الرسمية... حين يختلط الوصف بالحجية
يغيب عن قطاع عريض من الناس التمييز بين «رسمية الورقة» بمعناها العام، وبين «رسمية المحرر» بمعناها الفني الدقيق؛ فيختلط المصدر بالحجية، والتخصيص بالإثبات، والورق الرسمي بالمحرر الرسمي، حتى يصبح اللفظ الواحد حاملا لمعنيين متغايرين، ويصبح الخلاف في كثير من الأحيان خلافا في الاصطلاح قبل أن يكون خلافا في الحقيقة.
والحقيقة أن للورقة الرسمية معنى قريبا، ومعنى بعيدا، كم…
ومن هنا، فإن استخدام ورقة حكومية في غير الغرض الذي أعدت له ليس بالضرورة جريمة، ولا يصح القفز من مجرد المخالفة في الاستعمال إلى اتهام صاحبها بارتكاب فعل مجرم دون نص وأركان ودليل؛ لكن في المقابل لا يصح أيضا أن يقال إن الورقة الحكومية، لمجرد أنها لا تتمتع بالحجية الخاصة للمحرر الرسمي، أصبحت ورقة شخصية لا قيد على استعمالها.
