虚拟形象受损如何认定？全国首起虚拟主播违约案判了 日前，江苏省苏州市虎丘区人民法院审理了全国首起虚拟主播违约纠纷案。 2023年7月，因小史连续3个月没播满双方约定时长，且经公司多次提醒仍不直播，原告公司向她发送违约通知，明确解除合同，并要求小史支付违约金4万多元和虚拟形象损失1万多元。双方协商没有结果，公司就起诉到了法院。 法院经审理认为，本案涉及虚拟形象，属于虚拟财产，受法律保护，小史作为真人演员，擅自违反合同协议停播，违约事实明显，应当承担相应的违约赔偿责任。 苏州互联网法庭法官 吴娅：我们综合考量公司的实际损失和预期利益损失，兼顾小史的违约情况和对其惩罚性因素，认定双方之间合同约定的违约金数额过高，酌情调整为小史应向公司支付违约金6200元，同时判决双方解除合同。（央视新闻） https://www.thepaper.cn/newsDetail_forward_29694096
