Парадокс состоит том, что те же судьи, принимавшие это решение, неоднократно говорили, что законную неустойку в пользу владельца вагонов взыскивать нужно несмотря на договорные условия, т.к. в законе установлен свой срок на погрузку (выгрузку). И он обычно значительно короче, установленного договором. Но это императивная норма, поэтому договорный срок игнорируем.

Это тоже новинка от московской кассации, ранее она же придерживалась противоположного подхода, о том, что ОАО "РЖД" должно в порядке, установленном законом доказать существование обстоятельств, препятствующих исполнению принятых на себя обязательств. Решение по делу А40-301957/2024 принято в закрытом судебном заседании, его текстом с нами поделился представитель ОАО "РЖД"

Это свежий подход московской кассации. Теперь нельзя с РЖД взыскивать убытки, когда дорога не подает и не убирает вагоны с путей необщего пользования. Только копеешную неустойку по ст. 100 Устава ЖДТ. Еще и срок исковой давности по этим требованиям годичный.
