إن كان المراد بقول القائل إن الجهاد في فلسطين من فروض الكفايات أن الكفاية حاصلة بجهاد من يجاهد من المسلمين أهل البلاد هناك = فقد ثبت قطعًا أن من قام من المسلمين إلى يومنا هذا لقتال العدو الصائل عليها لم تتحقق بهم الكفاية المطلوبة = إذ لم يخرج العدو صاغرًا من الديار فترجع إلى أهل الإسلام = فلم يسقط الإثم عن الباقين.
