Сальдирование как заклинание.
В продолжение темы зачета и сальдирования в банкротстве.
В прошлом посте на эту тему главный вывод был таким: нельзя любой платеж по длящемуся договору объявить сальдированием. Если должник просто оплатил ранее выполненные работы, а у контрагента на дату платежа уже не было встречных обязанностей, это обычный платеж. И он может быть оспорен как предпочтительный.
