قاعدتاً شورای نگهبان باید به استناد اصل ۱۷ قانون اساسی مصوبه تعطیلی شنبه رو رد کنه. ظاهر قانون اینه که تعطیلی رسمی هفتگی حصر در جمعه دارد و اضافه شدن یک روز دیگر خلاف قانون اساسی است. اصل 17 قانون اساسی جمهوری اسلامی ایران مبدا تاریخ رسمی کشور هجرت پیامبر اسلام (صلی الله علیه و آله و سلم) است و تاریخ هجری شمسی و هجری قمری هر دو معتبر است، اما مبنای کار ادارات دولتی هجری شمسی است. تعطیل رسمی هفتگی، روز جمعه است
