قرار محكمة اسأناف كربلاء بصفتها التمييزيه بتاريخ 2024/9/24.. ان حبس المدين يقرره قاضي البداءة حصراً وينحصر دور المنفذ العدل في رفع طلب الدائن الى القاضي المختص للبت فيه، ولا يملك المنفذ العدل إصدار قرار بالحبس أو رفضه ، استنادً للمادة 40/ثانياً من قانون التنفيذ رقم 45 لسنة 1980 المعدل.
