Расперилась от результата! 🦜🤭 Взыскала с Делимобиль убытки и моральный вред за взлом аккаунта В один день клиенту начали приходить письма счастья с задолженностью на 11 тысяч за поездку. Чтобы разобраться, клиент зашёл в аккаунт - а у него просто не оказалось к нему доступа. ⬆️ Первая реакция части клиентов по ФЗ 115, когда говоришь, что нужны доказательства реальности ведения бизнеса: офис, работники, инструменты, подтверждение оказания услуг. К сожалению, магия не творится сама по себе: это все действительно нужно. А если это счёт физлица, то Банк может проверить законность получения денежных средств, которые вы кладете на счёт наличкой, запросы стартуют уже от 20-30 тысяч рублей. Но…

Достигли с Клиентом поистине довлатовского компромисса в стиле Баскина - выиграли дело о защите чести и достоинства, в иске оппоненту отказали. Изюминка была в том, что их спор касался, в том числе, авторского права: оба участвовали в создании спектакля "Чемодан" по Довлатову С.Д. (степень участия в процессе определения :)). Вот так опосредовано прикоснулась к произведению одного из моих любимых писателей.

ФНС продолжает запрашивать документы и пояснения с целью доначисления налога. Вызывает на допросы. "Казна пустеет, милорд". Их запросы всегда выглядят серьезно и пугающе, но это не значит, что они всегда правы - не забывайте! Важно либо представить документы, либо аргументированно отказать, если просят слишком много. 🪤

По ощущениям, суды начали тщательнее проверять поданные документы и с лупой искать повод для оставления иска без движения или возвращения, судя по обращениям Клиентов. Время между судебными заседаниями увеличивается: даже в суде общей юрисдикции стремится к месяцу. Высокая загрузка судей сохраняется - повышение госпошлин не решило проблему. Мысль проста: к досудебному урегулированию спора надо подходить не формально…

Мысль проста: за все хорошее и против всего плохого. Но чаще всего за это приходится бороться, а иногда и ходить в суд, о чем и буду тут рассказывать.
