آخر ما استقر عليه قضاء محكمة التمييز الاتحادية الموقرة بخصوص ((النفقة الماضية))، حيث لم يرد في أحكام مدونة الأحكام الشرعية ما يحدد المطالبة بالنفقة الماضية ((بمدة معينة))، فكان على المحكمة إجابة دعواها بخصوص ذلك وفي ضوء المدة التي طالبت بها بعد ثبوتها من خلال التحقيقات التي أجرتها، وأن ذلك لا يتعارض مع قاعدة ((لا يضار الطاعن بطعنه))، وإنما يتعلق بحسن تطبيق القانون كون المحكمة لم تراعِ ذلك الأمر.
