今天晚上跟朋友喝酒，聊到武汉大学这事，巧的是他正好认识当事男方的家庭，我觉得有点意思，从三个角度来聊聊。 首先是法院判决有没有问题。我认为是没有问题的，但其中存在一定的自由裁量权。 下面以原告（杨某某）与被告方（肖某某）来称呼当事双方。原告公布的证据视频为被告方中裤子外部有抓挠的动作。法院认为不构成性骚扰。 分两个部分来看： 1.公共场合对异性进行公开自慰是否涉及猥亵？ 由《治安管理法》第四十四条：“猥亵他⼈的，或者在公共场所故意暴露⾝体，情节恶劣的，处五⽇以上⼗⽇以下拘留……” 常见的司法认定中“猥亵⾏为”的范围较⼴，不限于直接⾝体接触，也包括通过暴露隐私部位、⾃慰、展⽰⾊情物品等⽅式，满⾜性欲、引起对⽅⽣理或⼼理不适等，尤其是在公共场合。 公开对异性自慰。情节严重，涉嫌强制猥亵他⼈罪。情节较轻，遵循治安管理法进行处罚。 2.中国法律中有没有“猥亵未遂罪”？ 中国《刑法》只规定了“猥亵罪”（⽐如猥亵⼉童罪、强…

为什么国内媒体一直在宣传很有机会进世界杯？因为只想吃流量炒热点，显得好像很关心中国足球一样。不过只是看上去关心而已。 足球实力是客观规律的产物，没有青训，没有庞大的青年球员基数，没有合理的选拔机制。就这样还在幻想14亿人里出几个天才球员来和其他国家竞争。就算亚洲区扩容到12个名额，一样大概率进不了。 三个字：闹麻了。 尊重客观规律，尊重科学，在建国76年后依旧需要不断呼吁，中国足球大抵就是中国的现状了。 #随想

尹锡悦想通过军队戒严彻底拿下反对党这个想法从理论上是可能的。 但是他做错了几件事： 1. 动作太慢，宣布戒严开始的同时应该抓捕议会反对党议员。 2. 军队中自己真正的支持者太少，导致解除戒严的政令颁布时军队执行比较顺畅。 3.道路和网络封锁不够迅速，应该以国会为中心，快速封锁道路以及死角。镇压群众的同时，切断有线以及无线通讯网络，逐步瘫痪整个首尔区域的通讯网络，避免反对党联络以及对外发布声明。 做到了这几点，在短时间内彻底清洗反对党才可能有机会保住自己的位置。 当然，以上这几件事真的想执行，在当今政治制度较为完备的韩国是基本不可能的。 现在已经不是全斗焕那个发动宫廷政变就能夺取权利的时代了。韩国准备了几十年就是防止这种事情再度发生。 至于尹锡悦为什么还敢干?只能当他脑子成浆糊了吧。 #随想

韩国反对党领袖李在明是想通过议会否决政令来瘫痪尹锡悦政府。 这实际上是香港“47人案”想要在香港做到的事情。 接下来就得看看到底是司法硬还是军队的枪管子硬了。 看来在韩国还是司法硬一些。 【[社论]把国民当傻瓜的“戒严令怪谈”】 2024-09-04 12:14 共同民主党连日发表阴谋论，称“尹锡悦政府正在准备戒严令”。党代表李在明说：“有人说为了防止国会要求解除戒严，计划在宣布戒严的同时逮捕和拘留国会议员。”虽然总统办公室对此予以否认，但民主党说：“存在举报和情况。在这个政权的某处可能正在策划戒严令。” 他们这是在毫无根据地乱主张，凡是有常识的人就肯定会摇头的怪谈。 可以说在当今世界，如果政府发动戒严令，军队里没有一个人会遵从，政府应该会几乎同时垮台。哪个政府会做出这种自残的行为？即使政府发动戒严令，如果宪法规定国会用在籍议员的过半数赞成要求解除戒严令，戒严就会立即被解除。在民主党和在野党占据192个席位的情况下…

之前提到过，ccp执政以来面临的最大危机并不是89学潮，而是90年代后期，国企破产，大量下岗工人成为社会真正的不安定因素，恶性事件是常态。 后来是通过加入世贸，成为“世界工厂”，重新抬高就业率，将无业游民投入社会生产之中，经济好转才有效保证了整个社会的稳定。 当前维稳的重点是放在如何处理大规模群聚带来的恶性事件（例如前几天被叫停的学生夜骑开封的事件），而针对个体突然“暴恐式“的袭击实际上依旧没有什么好办法。 哪怕全城都已经监控密布，有限的维稳力量也没办法处理这种即刻都有可能发生的袭击事件。 在已经冗官的大背景下，公务员系统依旧在进行扩招，说明ccp是想继续加强对基层控制能力，搭配网格员等体系，能够更好的掌握基层的人民。 我想到一个词：“内地新疆化”。”上锁菜刀“，”区域高强度安检“，“担保连坐”这一天可能不远了。 但是，同时要注意到：维稳的高成本和越来越孱弱的财政是相互矛盾。财政的萎靡必然带来的是维稳的难以为继。 …
