ليس كل شرط إعفاء في العقد يُعتد به. فالمادة (173) من نظام المعاملات المدنية أجازت الاتفاق على الإعفاء من التعويض عن الإخلال العقدي، لكنها استثنت الغش والخطأ الجسيم، ومنعت الاتفاق على الإعفاء من المسؤولية المترتبة على الفعل الضار. فالحرية العقدية واسعة، لكنها لا تحمي كل شرط.
الوصية لأحد الورثة لا تنفذ لمجرد كتابتها. فالمادة (179) من نظام الأحوال الشخصية اشترطت إجازة باقي الورثة لها بعد وفاة الموصي؛ فإن أجازها بعضهم دون بعض، نفذت في أنصبة المجيزين وحدهم. لذلك لا تكفي موافقتهم عليها في حياة الموصي.
ليس عليك دائمًا أن تنفذ التزامك أولًا ثم تطالب الطرف الآخر بالتنفيذ. فالمادة (191) من نظام المعاملات المدنية تجيز لك الامتناع عن الوفاء ما دام الطرف الآخر لم ينفذ التزامًا مرتبطًا بالتزامك، ولم يقدم ضمانًا كافيًا للوفاء. لكن يشترط أن يكون الالتزامان مرتبطين، لا مجرد دينين مستقلين.
قد تخسر العربون دون أن تقول صراحة: «عدلت عن العقد». فالمادة (44/ 3) من نظام المعاملات المدنية تعد سكوت دافع العربون حتى مضي المدة، أو عدم تنفيذه ما التزم به خلالها، عدولًا عن العقد. لذلك فترك المهلة تنقضي بلا تنفيذ قد يترتب عليه فقد العربون، ما لم يتفق الطرفان على خلاف ذلك.
صدور الحكم لا يعني أن بإمكانك تأجيل التنفيذ إلى ما لا نهاية. فالمادة (11) من نظام التنفيذ قررت أنه لا يُقبل طلب التنفيذ بموجب سندٍ تنفيذي مضى على تاريخ استحقاقه أكثر من عشر سنوات. لذلك، قد يكون التأخير سببًا في عدم قبول طلب التنفيذ، رغم بقاء السند التنفيذي قائمًا.
حتى لو بعت حقوق نشر كتابك، يبقى اسمك عليه حقًا لا يُباع. فالمادة الثامنة من نظام حماية حقوق المؤلف جعلت الحقوق الأدبية أبدية، لا تقبل التنازل ولا تسقط بالتقادم؛ ومنها نسبة المصنف إلى مؤلفه والاعتراض على تحريفه أو تشويهه. بيع الاستغلال لا يمحو المؤلف.
بلاغ التستر التجاري قد يكون له عائد مالي، لا مجرد أثر رقابي. فالمادة (18) من نظام مكافحة التستر تجيز مكافأة المبلّغ بما لا يتجاوز 30% من الغرامة المحصلة، بشرط أن يقدم معلومات تصلح لبدء التحقيق، وأن تنتهي القضية بحكم أو قرار نهائي، وألا يكون مدانًا فيها.
قد تسمع المحكمة شهادة الشاهد دون أن يراه المتهم أو يعرف هويته. في الجرائم الكبيرة، أجازت المادة الثالثة من نظام حماية المبلغين والشهود والخبراء والضحايا الاستماع عن بُعد، وتغيير الصوت والصورة، وإخفاء اسم الشاهد في صك الحكم عند الحاجة. الحماية هنا وسيلة لظهور الحقيقة.
وجود شرط تحكيم لا يعني أن تنتظر حتى يضيع محل النزاع. فالمادة (22) من نظام التحكيم أبقت للمحكمة المختصة سلطة إصدار تدبير مؤقت أو تحفظي قبل بدء التحكيم، كما يجوز لها ذلك أثناء سيره بطلب من هيئة التحكيم. التحكيم يفصل في أصل النزاع، أما الخطر العاجل فلا ينتظر.
لا تنخدع بعبارة: «الوكالة تُلغى في أي وقت». المادة (503) من نظام المعاملات المدنية قررت أن للموكل عزل وكيله أو تقييد وكالته، لكنها استثنت الوكالة الصادرة لمصلحة الوكيل أو الغير؛ فلا تُلغى أو تُقيّد دون موافقة من صدرت لمصلحته. فعبارة «ألغيت الوكالة» لا تكفي دائمًا.
في الاسم التجاري، التشابه لا يُقاس بالنشاط فقط. فالنظام يحظر حجز أو قيد اسم تجاري يشابه اسمًا محجوزًا أو مقيدًا ولو اختلف النشاط، كما يحظر ما يشابه علامة تجارية مسجلة أو مشهورة ما لم تكن مملوكة لطالب القيد. المرجع: نظام الأسماء التجارية، م7.
دفعت لمتجر إلكتروني وتأخر طلبك؟ إذا زاد التأخير على 15 يومًا من تاريخ العقد أو الموعد المتفق عليه؛ جاز لك فسخ العقد واسترداد ما دفعته والتكاليف المترتبة على التأخير، ما لم يكن سببه قوة قاهرة. ويلزم المتجر بإبلاغك بأي تأخير متوقع مؤثر. المرجع: نظام التجارة الإلكترونية، م14.
