قانون حمایت خانواده تاریخ تصویب : اسفند 1391 ماده ۲۱: نظام حقوقی جمهوری اسلامی ایران در جهت محوریت و استواری روابط خانوادگی، نکاح دائم را که مبنای تشکیل خانواده است مورد حمایت قرار می دهد. نکاح موقت نیز تابع موازین شرعی و مقررات قانون مدنی است و ثبت آن در موارد زیر الزامی است: ۱ـ باردارشدن زوجه ۲ـ توافق طرفین ۳ـ شرط ضمن عقد

به تصریح ماده 21 #قانون_حمایت_خانواده مصوب سال 1391 ، ثبت ازدواج موقت در صورت عدم بارداری زوجه، عدم توافق طرفین و نبود شرط ضمن عقد، الزامی نیست و متعاقدین ازدواج موقت که تمایل به خصوصی نگه داشتن رابطه خود با یکدیگر هستند، مرتکب جرم نمیشوند. خواندن خطبه عقد موقت بین متعاقدین توسط خودشان و یا عاقد و اعلام زوجیت آن ها به صورت شفاهی، خلاف قانون نیست و مطابق موازین شرعی و مقررات قانون مدنی است.
